Terms of Service

The short version

  • Whiteboard IQ is software for coaches and their athletes. Coaches are responsible for the training they program; the app and its AI only help.
  • Exercise has risks. Nothing in the app is medical advice.
  • Athletes under 18 need a parent or guardian's consent. Coaches must be 18 or older.
  • You own your content. You let us store and process it to run the app.

1. Agreement

These Terms are an agreement between you and Whiteboard IQ ("we", "us") for using the Whiteboard IQ app and website (the "Service"). By creating an account, accepting an invite or using the Service, you agree to these Terms and to our Privacy Policy. If you use the Service for a gym or business, you agree on its behalf and confirm you're allowed to.

Give accurate information, keep your password private, and tell us right away at support@whiteboard-iq.com if you think someone else used your account. You're responsible for what happens under your account. A gym owner can remove coaches from the gym; a removed coach loses access to the gym's athletes.

6. Health and safety

Physical training, including CrossFit, HYROX, running, swimming and weightlifting, carries a risk of injury. Athletes should check with a doctor before starting or changing a training program, train within their abilities, and stop and get medical help if something feels wrong. The Service, including its AI features, doesn't provide medical advice, diagnosis or treatment. If a log mentions pain or illness, the app may highlight it to the coach, but it can miss things and is no substitute for a coach's or doctor's attention. You use the Service and do the training at your own risk, to the extent the law allows.

7. AI features

The Service uses AI to suggest scores, summarize training, flag possible issues and draft or review programming. AI output can be incomplete or wrong. Coaches review it before relying on it, and remain responsible for the training they program and the messages they share. Training information is sent to our AI provider to produce these features, as described in the Privacy Policy. Use of AI features may be subject to reasonable fair-use limits.

8. Your content

You keep ownership of what you put into the Service: workouts, results, notes, comments and videos ("Content"). You give us permission to host, store, copy, process and display your Content only as needed to run, secure and improve the Service for you, and to share it with the people in your gym who are allowed to see it. You confirm you have the rights to the Content you add, and that videos don't include people who haven't agreed to be filmed.

9. Acceptable use

Don't: break the law or anyone's rights; harass, threaten or exploit anyone, especially minors; upload harmful code; try to access accounts, gyms or data that aren't yours; probe or overload the Service; copy, resell or reverse-engineer it; or use it to build a competing product.

10. Fees

The Service is currently offered at no charge during our early-access period. We'll give gym owners notice and the choice to cancel before any paid plan starts. Paid plans, when offered, will be described at sign-up and billed as stated there.

11. Ending use

You can stop using the Service at any time and ask us to delete your account. We may suspend or close accounts that break these Terms or put others at risk, and will try to give notice first when reasonable. If we stop offering the Service, we'll give gym owners reasonable notice and a way to get a copy of their data.

12. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose, accuracy and non-infringement. We don't promise the Service will be uninterrupted or error-free, or that any training result will be achieved.

13. Limitation of liability

To the fullest extent the law allows, we aren't liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data, and our total liability for any claim about the Service is limited to the greater of the amount you paid us in the 12 months before the claim or US $100. Some places don't allow these limits, so they may not apply to you.

14. Indemnity

If you're a gym owner or coach, you'll defend and hold us harmless from claims arising from your training programs, your Content, your handling of athletes' information, or your breach of these Terms.

15. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Disputes will be handled in the state or federal courts located in Texas, unless the law where you live requires otherwise. Before filing a claim, please email us so we can try to resolve it informally.

16. Changes

We may update these Terms. For important changes, we'll notify gym owners and users in the app or by email before they take effect. Continuing to use the Service after that means you accept the new Terms.
